If you have a will, congratulations. You have taken a meaningful step toward caring for the people you love, and that is worth celebrating. Many people never get that far.
But here is something we talk about with clients all the time: a will is the beginning of a solid estate plan, not the whole thing. You may have seen ads or online services suggesting that a quick will is all you need. In reality, a will only does part of the job. A complete estate plan fills in the rest, so that you and your people are covered in every season of life, not just at the end of it.
Here are five things a will alone cannot do, and how a thoughtful plan takes care of each one.
- A will only works after you are gone.
A will has no power during your lifetime. If you ever become unable to manage your own affairs, even temporarily, your will cannot help anyone step in for you.
That is where incapacity planning comes in. A durable power of attorney lets someone you trust handle financial matters on your behalf, and in Virginia, an Advance Medical Directive lets you name someone to make healthcare decisions and document your wishes for care. These documents let you choose, in advance and with a clear head, exactly who speaks for you. That is not paperwork. That is agency.
- A will must go through probate.
A will does not avoid the court process. It is essentially a set of instructions for the probate court, and in Virginia, that process is public, takes time, and involves costs and paperwork for your loved ones.
Many of our clients choose a revocable living trust as the centerpiece of their plan instead. Assets held in a trust can pass directly to the people you choose, privately and without court involvement. For many households, that simplicity is one of the greatest gifts you can leave behind.
- Some of your most valuable assets skip your will entirely.
Retirement accounts, life insurance policies, and payable-on-death accounts pass by beneficiary designation, not by will. If those designations are outdated or missing, your assets may not go where you intend, no matter what your will says.

- A will hands assets over all at once.
A will typically distributes property outright. For a young adult, that can mean receiving a significant inheritance at eighteen. For a loved one who receives government benefits, or someone navigating a difficult chapter, an outright inheritance can create real complications.

You can provide for the people you love on a timeline and in a structure that actually serves them, whether that means staggered distributions, ongoing management, or protections designed around their unique circumstances. Every household is different, and your plan can reflect that.
- A will cannot fully protect your pets.
For so many of us, pets are family. But legally, a will can only leave your pet to someone as property. It cannot set aside funds for their care or ensure your wishes for them are followed.
A pet trust can. It names a caregiver, provides money for food, veterinary care, and comforts, and gives you confidence that your companion will be loved the way you love them now.
